According to reports, the Uddhav Thackeray-headed faction of the Shiv Sena has moved to the Supreme Court (SC) against the proceedings commenced by the Election Commission of India (ECI). This is reportedly on a request made by the Eknath Shinde-headed faction for recognition as the "real" Shiv Sena as well as their claim over the party's symbol, the bow and arrow. 

Based on accounts, an application has been filed in the writ petition by Subhash Desai. The current application looks into the SC's indulgence to implead the ECI as a needed party in the writ petition which among other things challenges the Maharashtra Governor's decision to invite Shinde to become Chief Minister. 

It went on to reportedly assert that even though the Court was assured by the Speaker's counsel that further proceedings will not be conducted on the issue of disqualification, the Shinde-faction commenced proceedings to seek recognition as the real Shiv Sena by the ECI. Moreover, they also claimed the right to make use of the election symbol given to the Shiv Sena. 

Therefore, the Thackeray faction has requested the ECI to not proceed with the issue naming similar problems which are pending before the SC. It maintained that the ECI should not move ahead with the proceedings because those who are claiming the symbol are yet to be determined by the Court. 

Earlier, a notice was served to the Thackeray faction where the ECI mentioned that the Shinde and others wish to be recognised as the real Shiv Sena and are thus claiming right over the symbol.
