A 46-year-old Colaba resident, who was charged with raping a 29-year-old lady, recently granted bail by a sessions court in Mumbai.

The police reported that the accused had presented an 11-month, seven-point agreement that he claimed the complainant signed, which contained a provision that released him from any liability should they actually have a physical relationship. Meanwhile, the woman's attorney claimed in court that the signature on the paper was fake.

The police claim that the accused works for a government agency, and the woman looks after the elderly. The complainant claimed that the accused had repeatedly raped her and refused to be married despite having pledged to marry her and claiming to be divorced.

In her testimony to the police, the woman claimed that in October 2023, a friend had introduced her to the accused. She stated that the accused identified himself as a government employee when she paid him a visit for the first time. The complainant revealed to the accused that she was divorced and had a son after a few hours of chatting. After he persuaded her that he would marry her, the accused is said to have had sexual contact with her consent.

After a few days, the accused urged the woman to travel to Alibaug with his friends, even though the complainant had promised to stay in contact by phone. They were involved in sexual relations for five days during the trip, the statement claims.

The accused allegedly told her after a few more encounters that he had inappropriate images of her and that he would release them if she stopped seeing him. The accused allegedly offered the victim medication to end the pregnancy after she told him that she had become pregnant.

In January, the accused asked the woman to visit his house. When she did, the victim discovered a woman there claiming to be the accused's wife. She realised that the accused cheated her by promising to marry her, even though he is already married, the woman claimed in her statement.

The woman filed a police report (FIR) at Colaba police station on August 23 in response to the incident. Then, the accused went to sessions court to request anticipatory bail. However, he was granted bail on August 29 based on the document.

In accordance with the contract, the man and woman were to live together from August 1, 2024, to June 30, 2025.

The second clause is that they would enjoy their time together in peace and won't bring any sexual harassment claims against one another during this time.

The third clause says that the lady would live with the man at his house and that they might break up at any moment with a month's notice if he thought the woman was acting inappropriately.

The woman's relatives were prohibited from visiting their home throughout their time together, as per the fourth provision.

The fifth clause states that the woman is not allowed to harass or cause the guy mental pain.

The sixth clause says that if the woman became pregnant, she would be the only one responsible and the guy should not be held liable.

The last clause says the accused would be held liable if the harassment caused him to suffer from emotional anguish that negatively impacted his life.

The investigating officer in the case, PI Jyoti Damale of the Colaba police station, stated that she had never encountered a live-in arrangement like this before. Based on the agreement and a ruling from the Supreme Court in a particular instance, the sessions court granted anticipatory bail. In addition to calling the witnesses in for questioning and recording their comments, police are also verifying this arrangement. Officials were also unaware of this agreement, officer added.
