The High Court on Wednesday, March 12, asked the state government whether it will investigate the alleged encounter of Akshay Shinde, accused of sexually assaulting two girls in a kindergarten in Badlapur, as an accidental death.
The case has been registered as an accidental death and a separate investigation is underway by the Criminal Investigation Department (CID). Senior advocate Amit Desai, representing the state government, reiterated his position during the hearing on Wednesday that a decision on whether to file a case in this case will be taken only after this investigation. At that time, a bench of Justice Revati Mohite-Dere and Justice Neela Gokhale asked the above question.

A person commits suicide and the police register it as an accidental death. However, later, when the family of the person concerned complains that it was not a suicide but a murder, a case is registered by the police on that basis. In the Shinde encounter case, his parents had written a letter to the local police and the concerned police commissioner, raising questions about the encounter and alleging that the child was murdered.
Therefore, the bench also asked the police why a case was not registered in this case, and whether we should assume that the case would be investigated as an accidental death and a chargesheet would be filed.
