On Saturday, March 22, a tiffin box supplier was detained for sexual harassment after reportedly emailing a 20-year-old Mumbai college student obscene pictures and videos.
The victim lives in South Mumbai's Chira Bazaar as a paying guest with two other students while attending a college in Churchgate.
The students used a tiffin service to order lunch and supper every day, and at 12:30 pm and 8:30 pm, a delivery person would drop off their food outside their apartment.
She had never spoken to the person delivering the food and was typically outside or at college when it was delivered, according to media reports that cite the FIR.
A new delivery man just took over the job after the regular one left for his hometown.
To provide him directions on where to store the tiffin boxes, the victim got in touch with him. However, she received pornographic images and videos from his WhatsApp number on March 19 at approximately 11 pm.
She instantly told her friends and roommates that she was shocked and upset. She went to the LT Marg Police Station the next day and lodged a complaint against the defendant.
FIR Filed Under Various BNS Sections:
Based on her statement, a formal complaint was filed under Section 67 of the Information Technology Act, 2000, which deals with publishing or sending pornographic content in electronic form, and Section 75 (1) (iii) of the Bharatiya Nyay Sanhita, 2023, which deals with showing pornography against a woman's will.
According to the media reports the police arrested the offender, a married guy whose family lives in Rajasthan. After being brought before the court, he was remanded to judicial custody.
It's not just images, sending any unwanted texts to women without their consent is also a crime. Last month while hearing a case Mumbai Sessions Court stated that it is considered obscene to send unwanted texts to women.
An unidentified woman receiving texts like "you are slim, look very smart and fair, I like you" at night is considered obscenity, according to a Mumbai Sessions Court ruling.
DG Dhoble, the Additional Sessions Judge (Dindoshi), made these remarks while sustaining the conviction of a guy who was charged with sending a former corporator pornographic messages via WhatsApp. An "average person applying contemporary community standards" must be used to evaluate the obscenity, according to the February 18 order.
