The state Industries Minister Uday Samant on Tuesday, July 9, announced that the Maharashtra government has prepared a legislation to take action against fake pathology laboratories, imposing penalties on those who break the law.
Shiv Sena leader Uday Samant further stated during the Question Hour in the state assembly that the proposed legislation would involve specific guidelines and regulations, and teams would be created to inspect violations.
He stated that pathology labs without registration will not be permitted to function.
Samant mentioned that the matter pertains to the departments of urban development, public health, and medical education.
BJP MLA Ashish Shelar accused fake pathology labs of stealing money and jeopardizing people's health.
He insisted on registering the numerous collection centers that have emerged over time and called for legal action to be taken against those who do not comply.
Rajesh Tope, a legislator from NCP (SP), suggested that the Nursing Home Act may need to be revised if the state government is unable to promptly enforce the new law.
The minister responded that the new law draft was prepared, and indicated that the Nursing Home Act could be revised if necessary.
Yogesh Sagar from the BJP stated that pathology serves as the foundation for all surgeries, leading to impoverished individuals resorting to fake laboratories for tests.
Shiv Sena (UBT) MLA Ajay Choudhary alleged that fake pathology labs operate in collaboration with government hospitals.
The conversation happened in response to a query by BJP lawmaker Sunil Rane, who requested information regarding the quantity of pathology labs in Mumbai. He was surprised by the government's response stating that current regulations in the Mumbai Municipal Corporation Act 1888 do not include a provision for registering pathology labs.
He stated that obtaining the Fire NOC, accreditation from the National Accreditation Board for Testing and Calibration Laboratories, certification in good clinical practices, and registration for bio-medical waste disposal are necessary.
The minister stated that the Maharashtra Paramedical Council had granted permission to 7,085 individuals to run pathology labs since 2019, with 182 of them located in Mumbai.
He mentioned that there were a total of 197 laboratories in hospitals owned by the city in Mumbai.
