The Shiv Sena-led Maha Vikas Aghadi (MVA) government on Wednesday blocked the Central Investigation of Bureau (CBI) from probing any case in Maharashtra without the prior consent of the state or higher judiciary.
The CBI, which is established by the Delhi Special Police Establishment Act of 1946, has a general consent by the state which was given on February 22, 1989. However, this has been withdrawn with immediate effect through an order issued by the home department of Maharashtra.
Maharashtra becomes the fourth state to withdraw the general consent given to the members of the Delhi Police Establishment. Rajasthan also withdrew the consent this year while West Bengal, Andhra Pradesh and Chhattisgarh withdrew it in 2019.
This means that the CBI will have to take permission to probe any case which falls into the geographical jurisdiction of the state. The decision comes after Maharashtra Chief Minister Uddhav Thackeray held a meeting with senior officials.
This move comes a day after the CBI filed a case to probe allegations in connection with a TRP scam in Uttar Pradesh’s Lucknow. The Maharashtra government interprets this as a threat by the central government to interfere with the ongoing investigation into TRP scam which involves Republic TV.
However, the decision will not affect the investigation into the Sushant Singh Rajput death case which is being carried out on the orders of the Supreme Court. The Uddhav Thackeray government and the Bharatiya Janata Party (BJP) have been involved in a tussle over the SSR death case.
Although the medical board of All India Institute of Medical Science (AIIMS) has ruled out the murder angle in the SSR death case saying that it is a case of hanging and death by suicide, the family of the actor has demanded the CBI to form a fresh medical board.
