Patanjali Ayurveda Limited non-compliance with the High Court's interim order in a trademark infringement case filed by Mangalam Organics Limited, is not doing well for the former. The court ordered the company to deposit INR 50 lakh within a week for violating the interim order prohibiting the sale of camphor products.
The injunction issued by Patanjali on August 30, 2023 is being continuously violated. However, the Court will not tolerate such continued flouting of its order. Therefore, a single bench of Justice Riyaz Chagla ordered that Patanjali should deposit INR 50 lakh in the court before passing a final order on the contempt petition. Mangalam Organics had moved the court against Patanjali, claiming infringement of its proprietary rights to its camphor products.
Taking cognizance of this claim, the court on August 30, 2023 prohibited Patanjali from selling camphor products. However, Mangalam Organics once again approached the High Court claiming that camphor products are still being sold by Patanjali. Also, a contempt petition was filed against Patanjali.
Subsequently, Patanjali filed an affidavit on June 2 seeking the court's apology and promising to comply with the court's orders. However, in an affidavit filed by Rajnish Mishra, director of Patanjali Ayurveda, the company admitted to violating the court's interim order.
Camphor products worth 49,57,861 rupees were sold after the court's injunction. Also, camphor products worth 25,94,505 rupees are still lying in wholesalers or distributors and official shops. Also, Patanjali admitted through an affidavit that it was kept at the relevant place. The court took cognizance of Patanjali's admission of violation of the order.
Also, Patanjali sold camphor after the order and recently, on July 8. Moreover, the company's website also said that the camphor product was listed for sale. Therefore, the injunction has been defied and the court ordered that Patanjali should deposit INR 50 lakh in the court.
