The High Court on Friday handed over the investigation of the case to the Central Bureau of Investigation (CBI), citing several flaws in the Mumbai police's investigation into the murder of former corporator Abhishek Ghosalkar of Shiv Sena's Uddhav Thackeray group.


Many aspects of the case have not been investigated by the police. These aspects need to be investigated. Otherwise, proper justice cannot be given, said the bench of Justice Revati Dere and Justice Shyam Chandak while handing over the investigation of the case to the CBI. The court also commented that this is a cold-headed murder and the whole process of the murder was seen by everyone through Facebook Live and these murders shocked everyone.


The court also said in the order that although the Mumbai police has claimed to have investigated the murder from all aspects and thoroughly, considering the evidence, the reality is different. If the maze of suspicious circumstances surrounding this murder is not penetrated and important aspects of the murder are not investigated, it will amount to a travesty of justice. Flaws in investigations cannot be ignored, otherwise justice will be denied. Therefore, there is a need for a thorough investigation of the entire case, the aspects which were not investigated by the police, the court also said in the order.

Ghosalkar has been brutally and mercilessly murdered. The court also said that this was a cold-headed murder of a former councilor and it was seen by everyone on Facebook Live broadcast from Maurice Noronha's office. The court also primarily noted that though Ghosalkar belonged to a particular political party, his wife had not made any allegation that any other political party was involved in the murder. In rare and exceptional cases the investigation may be transferred to CBI. Also, cases must be investigated in such a way as to maintain public confidence in the impartial functioning of the investigative agencies of the state. Therefore, the bench of Justice Dere and Justice Chandak in the order primarily stated that the investigation was not conducted because of the allegations against the police.


Investigation by Superintendent of Police

The court ordered the CBI Divisional Director to appoint an officer of the rank of Superintendent of Police in the IPS category to investigate the case. Also, the Mumbai Police has been ordered to hand over the investigation documents conducted so far to the CBI within two weeks.

Ghosalkar's wife Tejashwi approached the High Court expressing dissatisfaction with the investigation by the Mumbai Police.
