The proposal by Growels 101 Mall in Kandivali (East) to realign the road has been denied by the Brihanmumbai Municipal Corporation (BMC)'s road development department owing to the long-pending land parcel handover dispute between them.

The BMC has been persistently pleading with the mall authorities to handover the road development plan (DP) road and recreational ground (RG) plot.

The civic body has been urging for more than 13 years to give them RG plot and DP road that were proposed under the DP 1991 and 2034 in the area around the mall.

Years of correspondence between the BMC departments and the mall administration, however, have been in vain since the mall has failed to turn over the aforementioned land parcels to the civic body.

Grauer and Weil (India) Ltd., the mall's manager, wrote to the BMC in March, requesting a realignment of the road because the garden reservation has been divided into two parts, with the 18.30 m wide DP road passing between them, following the first notice sent by the BMC this year in February.

The letter read that it is believed that by realigning the DP road such that the entire reservation is in one location, the fragmentation of the reservation can be avoided. The owners are currently completing the realignment plan that will be presented to BMC for approval. After the realignment proposal is approved, the reservation can be released.

However, the mall's request to move the RG reservation was denied by the BMC. It stated that although the mall had previously received favourable consideration from the civic body, the proposal had not been submitted. The BMC requested that the mall turn over the road right away in a letter that was delivered to it by the Chief Engineer of the DP department.

It was mentioned in the letter addressed to the mall authorities that the Building Proposal department has provided the Intimation of Disapproval (IOD), Completion Certificate, and Building Completion Certificate, among other documents, and the layout's development has been finished to a degree more than 50%. It is your duty to turn over to BMC the land impacted by the road and the RG reservation before issuing a Commencement Certificate for development that exceeds 50% of the land's potential with regular allowable FSI.

Santush Kumar Pandde, COO-Real Estate, Grauer & Weil (India) Ltd., said that they are committed to giving BMC the land for the proposed road's development; however, the development of the proposed land is put on hold until the Army Common Ordinance Depot (COD), which is located to the north of their property, hands over the land. Up until that point, they had suggested realigning the aforementioned property to facilitate traffic flow from Akurli Road to the Western Motorway. They have now formally approached the higher authorities at the Municipal Commissioner's office on May 24, 2024, to organise a consultation meeting in order to find a better solution to this matter that should help the general public, even though their request was denied at a lower level due to the complexity of the situation.

Santush Kumar Pandde said their application is presently being reviewed. Only until both the anterior and posterior portions of the planned DP Road are open for construction—a very tiny portion of the road now crosses through individuals' property—can the road benefit the populace. If BMC grants their request, the neighbourhood will greatly benefit from smooth vehicle traffic in this area. They have made a unique access through their property to facilitate vehicle traffic till then, at the request of a local political figure.
