New orders have been given by the state police that if a driver under 18 years of age is found, the vehicle should be impounded on the spot and taken into custody by the police. Apart from this, orders have been given that 20 years is the age limit for cargo transportation and it should be strictly followed. Apart from this, a model operating system has also been issued regarding e-challan.
Dr. Suresh Kumar Mekala, Additional Director General of Police, Traffic Department, has issued this circular. This procedure has been issued regarding issuance of e-challan and penal recovery as well as impoundment of vehicles. If a driver under 18 years of age is found, the vehicle is impounded by the police. Parents of the concerned driver or concerned person are summoned. Punitive action is taken against the driver as well as the guardian. Now, according to the new circular, the police will have to take action to impound the vehicle.
According to the regulations issued regarding e-challan, there are two types of e-challan namely compromise and non-compromise. It has been mentioned that in case of compromised e-challan, if the guilty person shows willingness to pay the amount voluntarily, the competent police officer should accept the amount and settle the e-challan. However, if the concerned person is not ready to pay the compromise amount, in such a case, the police should file a charge sheet in the court.
The circular orders immediate issuance of charge sheets in non-compromise cases. If the concerned person does not appear after filing the case in the court, the vehicle can be impounded. But for that, the vehicle should be impounded with due permission from the court.
The circular also states that vehicles should not be mutually impounded without the permission of the court. Sources said that the new circular has been issued by the state police because of the forced confiscation of vehicles by the police. Action will be taken against the concerned police who violate this circular.
