NGT Initiates Investigation into Pollution Claims

The National Green Tribunal (NGT) has ordered the continuation of a detailed environmental study into alleged pollution caused by Jakraya Sugar Ltd., located in Mohal Village, Solapur. Complaints from local residents have accused the sugar factory of discharging untreated effluents, disposing of spent wash through tankers outside its premises, and emitting smoke and fly ash from its boiler stack. Villagers claim that these practices have caused significant damage to crops, agricultural land, and groundwater in the area.

Committee Findings

Jakraya Sugar Ltd., in its defense, filed an interim application urging the NGT to first evaluate a Joint Committee Report dated February 5, 2024, before proceeding with further studies. The report revealed that Biochemical Oxygen Demand (BOD) levels in groundwater samples had significantly improved over time. For example, a dug well belonging to complainant Narayan Gund showed a decrease in BOD levels from 32 mg/l to 7.6 mg/l. However, the report also acknowledged that groundwater quality in the area was adversely affected during July 2021.

Expert-Led Investigation

The Maharashtra Pollution Control Board (MPCB), which has been monitoring the case, supported the appointment of the Institute of Chemical Technology (ICT), Matunga, Mumbai, to conduct an in-depth environmental damage assessment. In its affidavit dated October 23, 2024, the MPCB cited ICT’s expertise and previous experience in similar investigations, asserting that their study would provide a more comprehensive understanding of the issue.

Comprehensive Study by ICT

Responding to the MPCB’s recommendation, the NGT granted ICT the responsibility to proceed with its study, which is expected to take two months. The tribunal emphasized that this assessment is critical to determine the extent of environmental damage caused by the factory and to evaluate the effectiveness of its pollution control measures. Simultaneously, the NGT approved Jakraya Sugar Ltd.’s request to defer adjudication of the Joint Committee Report until ICT's findings are submitted.

Awaiting Final Verdict

The NGT plans to review both the Joint Committee Report and ICT’s analysis to ascertain the extent of environmental violations and decide on the necessary corrective measures. The case stems from a complaint filed by Narayan Gund, a local resident, who alleged that untreated effluent and improper disposal of waste by Jakraya Sugar Ltd. had polluted farmland and damaged crops in the vicinity. Additionally, emissions of smoke and fly ash from the factory’s boiler stack were reported to have exacerbated environmental degradation, impacting the livelihoods of villagers. The findings of ICT’s investigation are expected to play a crucial role in shaping the NGT’s final decision regarding accountability and remedial action. Meanwhile, residents of Mohal Village await a resolution that addresses their concerns and ensures the protection of their environment and livelihoods.
