The Election Commission explained to the High Court on Monday that the teachers of a private school in Kurla have been engaged in election work during the Diwali vacation, a day before polling and on the day of polling. Subsequently, the court disposed of the petition filed by the parents against making the teachers do election work during the examination period.
The parents of students of Green Mumbai Primary School in Kurla have challenged the circular to assign election work to teachers during the examination period, claiming that it is a violation of students' right to education. The court also took cognizance of this petition and ordered the Election Commission to clarify its position on this petition by Monday.

Against this background, a hearing was held on Monday before the bench of Justice Atul Chandurkar and Justice Rajesh Patil. At that time, the earlier circular regarding giving election duties to teachers was amended. Advocate Akshay Shinde, appearing for the commission, told the court that as per the revised circular, the teachers of the schools where the children of the petitioners were studying were assigned election duties only during the Diwali holidays i.e. from October 20 to November 12 and on the polling day, the day before the polling.
However, senior advocate Gayatri Singh, on behalf of the petitioners, also objected to the Commission's revised circular, saying that the teachers were busy checking the answer sheets during the Diwali vacation. The court, however, held that the revised circular of the commission was correct and addressed the fears of the municipalities. Likewise, the petition was disposed of by clarifying that the teachers should follow it.
