Ravindra Waikar, the leader of Shiv Sena (Shinde Group) from the North-West Constituency in Mumbai will continue to be an MP in the Lok Sabha elections. The High Court on Thursday rejected the election petition of Shiv Sena group (Thackeray group) leader Amol Kirtikar challenging his candidacy.
Kirtikar's plea is not hearable. The petition is not properly framed. Also, Kirtikar has failed to show how the tender votes were received by the winning candidate. Therefore, the single bench of Justice Sandeep Marne upheld the claim made on behalf of Waikar that his petition should be dismissed. Also, Kirtikar's petition was dismissed.
Meanwhile, 120 tender votes were lost during counting at the polling station and were not counted. There were a total of 333 tender votes. Out of them 120 tender votes were not counted. It was claimed by Kirtikar during the arguments that the recount of the tender votes was requested, but it was rejected. Several serious errors by the election officials appointed to conduct the counting process affected the outcome of the election. Also, it was observed that mobile phones were used in the counting center.
After repeatedly pointing out the issue, the court was also told by Keertikar that no action was taken till the twelfth day after the case was registered. Therefore, Kirtikar also claimed that tender votes were the main cause of controversy in the entire electoral process of this constituency.
What is the case?
Kirtikar was defeated by Waikar by 48 votes. Waikar got 4,52,644 votes while Kirtikar got 4,52,596 votes. Kirtikar, in the election petition, claimed that Vaikar's election as MP of the North-West Constituency should be annulled, claiming that he had filed an application for re-counting as a discrepancy was found on the day of counting of votes.
