Uddhav Thackeray's MLC nomination: MVA leaders exploring options to avoid constitutional crisis

The Maharashtra cabinet wants Governor Koshyari to nominate Uddhav Thackeray as an MLC from one of the two seats from his quota to avoid a constitutional crisis, but the Governor has not yet complied with the recommendation made by the state cabinet.

As the deadline of Uddhav Thackeray completing six months as the Chief Minister come closer, the Maharashtra Vikas Aghadi (MVA) leaders are looking for a way to avoid the constitutional crisis. 

A delegation of MVA leaders including Maharashtra Deputy Chief Minister Ajit Pawar, state Revenue Minister Balasaheb Thorat, state Urban Development Minister Eknath Shinde and other top leaders visited Raj Bhavan to meet Governor Bhagat Singh Koshyari demanding Uddhav Thackeray’s nomination to the legislative council. 

The Maharashtra cabinet, in a meeting led by Ajit Pawar, recommended Uddhav Thackeray’s name for his nomination as an MLC through the governor’s quota. The cabinet recommended Uddhav Thackeray’s name for the second time to Governor Koshyari who has two vacant seats. 

The state cabinet wants Governor Koshyari to nominate Maharashtra CM Uddhav Thackeray as an MLC from one of the two seats from his quota to avoid a constitutional crisis. However, the Governor has not yet complied with the recommendation made by the state cabinet. 

With this, the MVA and Shiv Sena leaders are exploring all options to get him nominated to the upper house of the Maharashtra legislature. The Sena leader will also be writing to the Election Commission regarding the issue. 

Maharashtra Chief Minister Uddhav Thackeray on Wednesday called up Prime Minister Narendra Modi over the phone to discuss his nomination to the legislative council urging him to intervene in the matter stating that the country was combating the deadly coronavirus or COVID-19 and that Maharashtra was the worst-hit state due to the pandemic. 

It has been learned that Shiv Sena leaders will wait for a few days to see if the call made by Uddhav Thackeray to PM Modi has some effects in the Raj Bhavan. The Shiv Sena leaders are exploring their legal options as well in relation to this matter. 

Uddhav Thackeray took oath as Maharashtra Chief Minister on November 28, 2019, and is not the member of either house - legislative assembly or council. According to the Indian constitution, within six months of taking the oath, any minister is supposed to get elected in either state legislative assembly or council.

The deadline for Maharashtra Chief Minister Uddhav Thackeray to get elected to the state legislature is May 27. The Election Commission has postponed the upcoming elections for the Rajya Sabha and other local bodies in the wake of the coronavirus pandemic.
