The Election Commission has decided to ban the carrying of mobile phones to polling booths on the lines of Assembly elections. The Bombay High Court clarified on Monday that this decision is not illegal in any way.


This time, the court rejected the Public Interest Litigation of the MNS challenging the decision of the Election Commission.


The Central Election Commission has the right to implement all necessary measures for the smooth functioning of voting and elections. A bench of Chief Justice Devendra Kumar Upadhyay and Justice Amit Borkar said while pronouncing the verdict. The petition was filed by MNS worker Ujala Shyambihari Yadav, which was dismissed by the High Court.

As the election process is very complicated, the petitioners demanded that the ID cards should be allowed to be displayed with the help of DigiLocker app. But, no person has the right to show documents as proof through mobile with the Digilocker app.


For this reason, the bench dismissed the petition underlining the fact that the Election Commission's decision banning the carrying of mobile phones to the polling station was not illegal in any way.


If mobile phones are allowed to be taken to the polling station, citizens are likely to show others which party they have voted for through photos or videos. The court upheld the Election Commission's rule saying it was likely to affect the privacy of voting and fair elections.
